The recent decision by the United Kingdom to repeal the legal presumption of parental contact marks a seismic shift in family law, one that could have devastating global consequences. For decades, courts have recognised that, except in proven cases of abuse or risk, children thrive when they have meaningful relationships with both parents. This fundamental principle has now been dismantled, paving the way for one parent to erase the other with little to no scrutiny.
Sinta Ebersohn, international Post Traumatic Growth mentor and founder of the award-winning global platform Fair Divorce, warns that this change will embolden the misuse of protection orders and false allegations in high-conflict divorces, where one parent weaponises the legal system to gain sole custody and alienate the other.
“Repealing the presumption of parental contact does not protect children. It destroys families from within. It hands immense power to the parent willing to lie, manipulate and alienate,” says Ebersohn. “Every child deserves the love of both parents unless there is clear and proven danger. This new legal direction abandons that truth.”
