Rogan Bruce Appointed Director and Head of Trade Marks at Smit & Van Wyk, Inc.

Smit & Van Wyk, Inc., a leading Intellectual Property law firm operating across South Africa and the African continent, is pleased to announce the appointment of Rogan Bruce as Director and Head of Trade Marks.
The appointment marks a significant milestone in Rogan's decade long career at Smit & Van Wyk and reflects the confidence and trust the firm has in his proven track record within the trade marks department.
A Decade-Long Journey at Smit & Van Wyk
Rogan Bruce joined Smit & Van Wyk Attorneys in March 2016 as a Candidate Attorney within the trade marks department. Over the following years, Rogan become an attorney of the High Court in 2018 and completed his specialist trade mark exams in 2019. Since then he has been managing the trade marks department and his primary focus has been on trade mark oppositions and litigation.
"Managing cases places a person under significant pressure to perform, and it sometimes challenges the belief you have in your own abilities. However, after successfully completing a matter, obtaining a positive result, and knowing that it has all been handled correctly is an incredibly rewarding experience." Taking over leadership of the trade marks department has carried similar weight, affirming that Rogan’s contributions and abilities are valued by the firm and are widely recognised.
From the Lecture Hall to a Career in Trade Marks
Rogan's interest in intellectual property law took root during third year at the University of Pretoria, where he completed both a BA Law and an LLB degree. An Intellectual Property module introduced the subject of brand protection and the legal tests used to determine whether one brand is confusingly similar to another. Real-world examples of imitation products sparked an immediate connection to the field.
"I found it so interesting that I remember turning to my friends and saying, this is exactly what I want to do when I leave university," Rogan recalls.
Since then, Rogan has gone on to complete the SAIIPL trade mark practitioners exams and holds membership with both the South African Institute of Intellectual Property Law (SAIIPL) and the International Trademark Association (INTA).
Becoming Director
Stepping into the role of Director represents both a personal and professional milestone for Rogan. "It's a huge honour that I was considered for this role, and I believe it speaks to my commitment to the firm, its people and our clients," he says.
Looking ahead, Rogan's ambitions for the role extend well beyond personal achievement. "Overall, I want to grow the firm into one of the leading IP firms in Africa,". "There is huge potential for growth in IP services across Africa, and if I can contribute to the firm's successful expansion into Africa and into other IP-related services, then that would be amazing."
With a capable team already in place, Rogan’s focus is on expanding the firm's IP services and improving efficiency, not only within South Africa but across the broader African continent.
Notable Matters and a Genuine Passion for the Work
Asked about the most memorable matters handled over the years, he points to the defence of a client accused of manufacturing counterfeit goods as among the most demanding, an urgent case that once meant getting into bed at 2am and being back at work by 7am. He also describes currently working on a matter considered among the most interesting and enjoyable of an entire career so far.
What keeps the work engaging, according to Rogan is the breadth of industries trade mark law touches. "It's fascinating to be dealing with one industry in the morning and then by the afternoon you are dealing with a different industry," he says, adding that lessons learned in one sector have often helped resolve issues in another.
Mentors Who Shaped a Career
Rogan credits two women in particular for shaping the path to Director: Noelle Pearson, described as "an absolute powerhouse of knowledge when it came to trade mark law," who guided him through the fundamentals early on, and Gillian O’Leary, a more experienced attorney who supported him through early cases and set a standard of accepting nothing less than the best version of the work.
"I am the product of these two incredible women, and I have to thank them both for the confidence I have in myself when dealing with matters today".
An Approach Defined by Three Words
Asked to sum up a professional philosophy in three words, Rogan settled on: Client-focused. Practical. Efficient. " I'm not doing law just for the sake of doing law; I want to assist clients in the best possible way".
The Changing Face of Trade Mark Law in South Africa
Rogan observes that while the fundamentals of the trade mark landscape in South Africa have remained largely consistent, client awareness has shifted. More businesses now understand the value IP brings and are proactively seeking protection and enforcing their rights. As South African businesses increasingly operate on an international scale, demand for cross-border brand protection continues to grow.
He also anticipates change on the horizon as artificial intelligence becomes more embedded in commercial life. Greater reliance on AI to generate intellectual property and draft related agreements is likely to bring new categories of dispute. Rogan further suggests that AI shopping assistants may eventually become the primary entities exposed to brands in the marketplace, rather than consumers directly, and this could change the legal test for confusing similarity.
Advice for the Next Generation of Trade Mark Attorneys
Rogan considers trade mark law "the fun side of law" and offers three pieces of advice to those considering the field: approach every matter with an open mind and a willingness to have your views challenged, commit to continuous reading to build a strong grasp of the fundamentals, and be patient with your mentors.
