Invitation to Join Legal action - Permanent Residence applications pending for more than 8 months
Written by: Leon Save to InstapaperBackground and info
We have a number of clients who have applied for permanent residence over the last 5 years, who have not yet had decisions from Home Affairs. The official turnaround time has been published by Home Affairs and VFS as 8 months. The applications which we are referring to here have been accepted by Home Affairs as complete and do not have any pending queries.
Invitation to join this action:
If you submitted your PR application on your own and this is the first email you are receiving regarding this matter, you are welcome to contact us on email This email address is being protected from spambots. You need JavaScript enabled to view it. to join this action.
Plan
We have grouped these applications together and discussed group legal action with another Immigration Practitioner who has a number of applications which are also outstanding for more than 8 months. We have approached legal counsel and been advised that the costs of the matter can be drastically reduced if this is handled as a single-issue group action (failure to decide PR during established turnaround time of 8 months).
If there are other issues with PR applications, we will have to tackle these as separate/group actions after we have more information on the issues. We will be ready to launch this action within the next few weeks, as soon as we have enough people on board.
Once we have an indication of interest and payment, we will send each applicant a few documents to complete which can be scanned back to us. Costs As a group, we can keep the cost of an individual action down to an amount of R3500-00 per applicant, which will be reduced for family groups where the application involved a main applicant and dependents.
This should be paid to our account and the POP sent to This email address is being protected from spambots. You need JavaScript enabled to view it. with your name as a reference.
