However, when it comes to your rights as an employee, the Department of Employment and Labour plays a key role in ensuring fair treatment in the workplace.
What Does the Department Actually Do?
The Department’s main mission is to regulate the labour market and uphold your constitutional right to fair labour practices. It does this through the enforcement of several key laws:
- Labour Relations Act
- Basic Conditions of Employment Act
- Employment Equity Act
The Department also ensures compliance with Occupational Health and Safety legislation, administers Unemployment Insurance Fund (UIF) benefits, and manages Compensation for Occupational Injuries and Diseases (COIDA).

Like many public institutions, the Department of Labour isn’t immune to the usual administrative hiccups, think unanswered emails, phones that ring into the void, and queues that test your patience (and your snack supply). When You Might Need to Interact with the Department
Here are the most common scenarios:
Unfair Labour Practices
Examples include underpayment of wages, non-compliant contracts, or no contracts at all.
What to do:
Skip the email and phone call. Head straight to your nearest Labour Department office. Once you lodge a complaint, an inspector may be sent to your employer’s premises. If your claims are valid, a compliance order will be issued.
- Employers usually have 14 days to fix general non-compliance.
- For health and safety issues, they get 60 days.

- Payslips or proof of underpayment
- Written complaint (optional but helpful)

Claiming UIF Benefits
Whether you’ve lost your job, gone on maternity leave, or are temporarily unable to work, UIF is meant to help you stay afloat.
What to do:Again, go in person. Stories of moms receiving their first maternity payment when their baby is already walking are sadly not urban legends. The earlier you submit your documents, the better.
Forms to bring:
- UI-19 (completed by your employer)
- UI-2.8 (bank form)
- UI-2.7 (proof of termination)
- ID and proof of banking
- Medical certificate (for illness/maternity)
Workmen’s Compensation (COIDA)
If you’ve been injured at work or contracted a work-related illness, your employer is responsible for submitting the paperwork.
What to do:Make sure your employer completes and submits the W.Cl.2 form (Employer’s Report of Accident). You can follow up with the Department if things stall.
