The South African AI Association Raises Concern About AI Model Training by the LinkedIn Platform

The South African Artificial Intelligence Association (SAAIA), an industry body promoting the advancement of responsible AI in South Africa, has submitted a complaint to the Information Regulator of South Africa regarding LinkedIn’s use of personal data to train AI models without obtaining prior consent.

SAAIA advocates for responsible AI to ensure the commercial and societal benefits for South African citizens, with a focus on economic growth, investment, equality, and inclusivity. The association unites practitioners from sectors including commercial, government, academia, start-ups, and NGOs.

Responsible AI and Data Privacy Concerns

Dr Nick Bradshaw, the founder of SAAIA, remarked, “The race to build new AI products and services is global, but its impact is often local. We are monitoring the rapid pace of AI innovation as vendors and investors invest heavily to bring new offerings to market. However, we are assessing whether this is being done responsibly. Individuals and nations must not be disadvantaged, especially when it comes to the use of personal data to train AI-powered platforms.”

Submission to the Information Regulator

Nathan-Ross Adams, SAAIA Advisory Board member and head of regulatory affairs, led the drafting of the submission to the Information Regulator. The complaint against LinkedIn highlights concerns over the platform’s use of South African users' personal data for training generative AI models, pointing out:

1) The processing of data does not meet the conditions for lawful processing under Chapter 3 of POPIA.
2) LinkedIn’s conduct may constitute interference with personal information, as outlined in section 73 of POPIA.
3) Given the significant public interest, the matter requires investigation by the Information Regulator.

"This is more than just a legal matter; it's about protecting the rights of individuals in an age where data is currency. SAAIA’s mission is to ensure that as AI grows more powerful, it also grows more accountable," said Adams.

The Need for Responsible AI

Bradshaw concluded by stressing the importance of inclusive AI development:
"Our mission is to engage society in this debate, be they citizens or governments, AI novices or AI experts. No one should be left behind in the race to embrace AI. It is crucial that the opportunities presented by Artificial Intelligence are grounded in Responsible AI principles and do not benefit only a select few."

SAAIA is awaiting feedback from the Information Regulator of South Africa on this important issue.
